When you visit our website and use our services, you trust us with your personal information. We take your privacy very seriously. We seek to explain to you in the clearest way possible what information we collect, how we use it, and what rights you have in relation to it. If there are any terms in this privacy policy that you do not agree with, please discontinue use of our site and our services.

01 —What information do we collect?

Personal information you disclose to us

In Short: We collect personal information that you provide to us such as name, address, contact information, passwords and security data, payment information, and social media login data.

We collect personal information that you voluntarily provide to us when expressing an interest in obtaining information about us or our products and services, when participating in activities on the Sites, or otherwise contacting us. The personal information we collect can include the following:

In Short: We process your information for purposes based on legitimate business interests, the fulfillment of our contract with you, compliance with our legal obligations, and/or your consent.

We use personal information collected via our Sites for a variety of business purposes described below. We use the information we collect or receive:

  • To facilitate account creation and logon process [with your Consent]. If you choose to link your account with us to a third party account (such as your Google or Facebook account), we use the information you allowed us to collect from those third parties to facilitate account creation and logon process.

  • To post testimonials [with your Consent]. We post testimonials on our Sites that may contain personal information. Where you choose to do this, we will receive certain profile information about you from your social media provider. Our servers are located in the United States, but we may use other technology with servers located outside of the United States. In Short: We are not responsible for the safety of any information that you share with third-party providers who advertise, but are not affiliated with, our websites.

The Sites may contain advertisements from third parties that are not affiliated with us and which may link to other websites, online services or mobile applications. We cannot guarantee the safety and privacy of data you provide to any third parties. Any data collected by third parties is not covered by this privacy policy. We are not responsible for the content or privacy and security practices and policies of any third parties, including other websites, services or applications that may be linked to or from the Sites. 08 —How long do we keep your information?

In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this privacy policy unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy policy, unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements). No purpose in this policy will require us keeping your personal information for longer than 2 years past the termination of your account.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

09 —How do we keep your information safe?

In Short: We aim to protect your personal information through a system of organizational and technical security measures.

We have implemented appropriate technical and organizational security measures designed to protect the security of any personal information we process. However, please also remember that we cannot guarantee that the internet itself is 100% secure. In Short: We do not knowingly collect data from or market to children under 18 years of age.

We do not knowingly solicit data from or market to children under 18 years of age. By using the Sites, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent's use of the Site. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. In Short: In some regions, such as the European Economic Area, you have rights that allow you greater access to and control over your personal information. You may review, change, or terminate your account at any time.

In some regions (like the European Economic Area), you have certain rights under applicable data protection laws. These may include the right (i) to request access and obtain a copy of your personal information, (ii) to request rectification or erasure; (iii) to restrict the processing of your personal information; and (iv) if applicable, to data portability. If we are relying on your consent to process your personal information, you have the right to withdraw your consent at any time. Please note however that this will not affect the lawfulness of the processing before its withdrawal.

If you are resident in the European Economic Area and you believe we are unlawfully processing your personal information, you also have the right to complain to your local data protection supervisory authority.

Account Information: You may at any time review or change the information in your account or terminate your account by contacting us at team@charismahacking.com. Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, some information may be retained in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our Terms of Use and/or comply with legal requirements.

Cookies and similar technologies: Most web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove cookies and to reject cookies. If you choose to remove or reject cookies, this could affect certain features or services of our Sites.

Opting out of email marketing: You can unsubscribe from our marketing email list at any time by clicking on the unsubscribe link in the emails that we send or by contacting us using the details provided below. You will then be removed from the marketing email list — however, we will still need to send you service-related emails that are necessary for the administration and use of your account. 12 —Do California residents have specific privacy rights?

In Short: Yes, if you are a resident of California, you are granted specific rights regarding access to your personal information.

California Civil Code Section 1798.83, also known as the "Shine The Light" law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below.

If you are under 18 years of age, reside in California, and have a registered account with the Sites, you have the right to request removal of unwanted data that you publicly post on the Sites. To request removal of such data, please contact us using the contact information provided below, and include the email address associated with your account and a statement that you reside in California. We will make sure the data is not publicly displayed on the Sites, but please be aware that the data may not be completely or comprehensively removed from our systems.

15 —AI features and data use

In Short: Founder Launch AI is an AI-powered product. When you use AI features, your inputs and outputs are processed by us and by third-party AI providers, and we retain broad rights to use this data to operate, improve, and develop our services, including to train and improve AI models.

AI Inputs and Outputs. When you use AI-powered features of the Sites — including chat, generation, analysis, agents, or any feature that processes your input through a large language model or other AI system — we collect and process the prompts, files, instructions, documents, transcripts, and other information you submit ("AI Inputs"), together with the responses, generations, summaries, recommendations, and other outputs produced ("AI Outputs"). AI Inputs and AI Outputs are collectively referred to as "AI Data."

Third-Party AI Providers. To deliver AI features, we transmit AI Data to third-party AI providers and infrastructure providers, which may include, without limitation, providers such as Anthropic, OpenAI, Google, Microsoft, Meta, and others, and which may change at our discretion without notice to you. These providers process AI Data according to their own terms and data use policies, which you are responsible for reviewing independently. We make no representation or warranty regarding the data practices of any third-party AI provider, including whether or not they retain, use, or train on AI Data.

License to AI Data. By submitting AI Inputs to the Sites, you grant Founder Launch LLC a worldwide, perpetual, irrevocable, royalty-free, sublicensable, and transferable license to access, use, store, copy, modify, reproduce, create derivative works of, publicly perform, publicly display, distribute, and otherwise exploit AI Data for any lawful business purpose, including without limitation to:

  • operate, maintain, and deliver the Sites and AI features;
  • monitor, debug, troubleshoot, and improve our services and underlying systems;
  • develop new features, products, services, agents, and offerings;
  • train, fine-tune, evaluate, benchmark, red-team, and improve our own models, prompts, embeddings, retrieval systems, agents, workflows, and AI systems;
  • create derived datasets, including aggregated, anonymized, de-identified, or synthetic datasets, which we may retain, use, license, share, sell, or otherwise commercialize without restriction and without further obligation to you, including after your account is terminated;
  • detect, investigate, and prevent fraud, abuse, security incidents, and policy violations;
  • conduct internal research, analysis, evaluation, and reporting;
  • demonstrate the capabilities of our services in marketing, sales, fundraising, and case study materials in anonymized or aggregated form; and
  • any other purpose disclosed in this privacy policy or otherwise permitted by applicable law.

Your Responsibility for AI Inputs. You are solely responsible for the AI Inputs you submit and for ensuring that you have all necessary rights, consents, licenses, and lawful bases to submit them. You agree not to submit (i) confidential information of third parties without authorization, (ii) personal information of any individual where you lack a lawful basis to share it under applicable law, (iii) protected health information (PHI), payment card data, government-issued identifiers, biometric identifiers, or other sensitive or special categories of personal information, or (iv) any content you do not have the right to share. You agree to indemnify Founder Launch LLC against any claim arising from AI Inputs you submit in violation of this section.

No Reliance on AI Outputs. AI Outputs are generated by probabilistic systems and may be inaccurate, incomplete, biased, outdated, offensive, or otherwise unreliable. AI Outputs do not constitute legal, financial, medical, tax, investment, or other professional advice. You are solely responsible for reviewing, evaluating, and independently verifying any AI Output before relying on or acting upon it, and for any consequences of doing so.

Retention. We may retain AI Data for as long as we determine is necessary or useful for the purposes described above, including in anonymized, aggregated, derivative, or synthetic form indefinitely, notwithstanding any contrary retention period stated elsewhere in this policy. Where AI Data has been incorporated into training datasets, fine-tuned models, embeddings, derived models, or aggregated datasets, deletion of your account or your AI Data from active systems will not require us to delete, retrain, or untrain such datasets, models, or systems, and your rights with respect to such derived materials are limited accordingly.

Requests Regarding AI Data. If you wish to request restrictions on the use of your AI Data for model training or research, contact us at team@charismahacking.com. We will consider such requests on a case-by-case basis at our sole discretion and are under no obligation to grant them except to the extent required by applicable law.

16 —A2P compliance

In Short: As a user, you will receive SMS messages from us only if you have provided explicit consent to receive such messages, and we will provide several methods to opt-out of receiving future messages.

Obtaining Consent: We ensure that all recipients of our SMS messages have provided explicit consent to receive such communications. This consent is obtained through clear, affirmative actions such as ticking a checkbox or opting in via a digital form.

Documenting Consent: Records of consent, including the time and method of consent acquisition, are maintained diligently to provide proof of compliance.

Transparency: Each message sent will clearly state its purpose, be it promotional, informational, or for alerts.

Relevance: Messages will be relevant to the user's expressed interests or prior interactions with our services.

Respecting Privacy: Personal data collected for A2P messaging will be used strictly for the purpose consented to by the user and not shared with third parties without additional consent.

Data Security: We commit to protecting the data collected and stored for A2P messaging with appropriate security measures to prevent unauthorized access and data breaches.

Easy Opt-Out: Every message will include a straightforward way for recipients to opt out of receiving future messages by replying STOP or UNSUBSCRIBE. You may also update your preferences by adjusting your status on your account page.

Prompt Action on Opt-Out Requests: We will process opt-out requests promptly and ensure that no further messages are sent to users who have opted out.

Adhering to Laws: Our A2P messaging practices will always comply with relevant local, national, and international regulations, including but not limited to GDPR, TCPA, and others pertaining to electronic communications.

Policy Updates: This policy will be reviewed and updated regularly to remain compliant with evolving laws and best practices in A2P messaging.
